Locate the will and open probate (state-specific)

Why it matters

There is no national will registry. The will names the executor and is filed with the local probate court — but rules and thresholds vary dramatically by state.

How to do it

1. Find the will (home safe, attorney, bank box). The named executor files it with the county probate court.
2. Many states offer a simplified "small estate affidavit" below a dollar threshold, avoiding full probate.
3. Assets with named beneficiaries (life insurance, retirement accounts, payable-on-death accounts) and jointly-held property usually pass OUTSIDE probate.
